1. Grant of Limited License :

UNO Capital may restrict, suspend or terminate your access at any time without liability. UNO Capital reserves the right to modify the service at any time. You acknowledge that availability is subject to change at the discretion of UNO Capital. UNO Capital has the right to terminate your access, without limitation, if it, in its sole discretion, considers your use to be unacceptable, breach by you of the terms (directly or through violation of rules applicable to you).UNO Capital may, but shall be under no obligation to, provide you a warning before termination.

3. Support Boundaries :

UNO Capital provides support or service to users and customers (except for holidays and non-working hours in the UAE.) We limit support only to the services that we provide. UNO Capital does not offer support for trade, travel, legal or business specific issues, or other such issues.

4. Nature of Internet Services :

User acknowledges that such a kind that service can be interrupted for reasons other than the negligence of UNO Capital and that damages resulting are difficult or impossible to ascertain.

Therefore, subscriber agrees that UNO Capital shall not be liable for any damages arising from such causes beyond the direct, exclusive and immediate control of UNO Capital. The user acknowledges that UNO Capital’s liability for its negligence may not, in any event, exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall UNO Capital be liable for special or consequential damages, loss or injury.

5. Warranties :

UNO Capital disclaims all liability for the accuracy, completeness, legality, reliability, or availability of information displayed in the Uno Capital services. UNO Capital also disclaims any responsibility for the deletion, failure to store, or untimely delivery, any liability for any harm resulting from downloading or accessing any information.

UNO Capital information and services are provided ‘as is,’ with no warranties whatsoever. UNO Capital and its licensors expressly disclaim to the fullest extent permitted by law all express, implied, and statutory warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights. UNO Capital disclaims any warranties regarding the security performance, any warranties for any information or advice, services or goods received through or advertised on the UNO Capital services or links provided.

You agree that you download or otherwise obtain material or data using the UNO Capital services at your discretion and risk and be solely responsible for any damages.

6. Limitation of Liability / Force majeure :

Under no circumstances shall UNO Capital be liable to any user on account of that user’s use or misuse of or reliance on UNO Capital services. Arising from any claim relating to this agreement or the subject matter hereof such limitation of liability shall apply to prevent recovery of direct, indirect, incidental, special, exemplary, and punitive damages whether such claim is based on warranty, contract, tort (including negligence), or otherwise.

Such limitation of liability shall apply whether the damages arise from use or misuse of and reliance on UNO Capital, from the inability to use the UNO Capital services, or from the interruption, suspension, or termination of the UNO Capital services (including damages incurred by third parties).

This limitation shall also apply concerning damages incurred because of other services received through, advertised or links provided. This limitation shall also apply, without limitation, to the costs of procurement of substitute goods or services, lost profits, or lost data.

Such limitation shall further apply concerning the performance or non-performance of the UNO Capital or any information that appears on or is linked or related to the UNO Capital services. Such limitation shall apply notwithstanding any failure of essential purpose of any limited remedy and to the fullest extent permitted by law.Without limiting the foregoing, under no circumstances shall UNO Capital be held liable for any delay or failure in performance directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet/utility failures, labor disputes, riots, civil disturbances, fires, acts of God, war, governmental actions, orders of courts, non-performance of third parties.

The user agrees to indemnify, defend and hold UNO Capital, its agents, subsidiaries, employees, and third parties (e.g. investors, consultants) (collectively ‘Indemnified Person(s)’) harmless from any third party claims, liability, loss, and expense (including damage awards, settlement, and legal fees), brought against any indemnified person(s), arising out of, related to or which may result from your use of the service, site(s), and/or your breach of any term of this agreement.

9. Confidentiality :

Due to the proprietary nature of the Service and trade secrets of UNO Capital contained therein, the user agrees not to disclose any information whatsoever about the Service or business practices, or direct others to do so without the written consent of UNO Capital.

If the user violates this section, the user as a result of this agrees to waive all rights to any judicial appeal and as a result of this stipulates that a court of competent jurisdiction shall enter judgment in favor of UNO Capital. Subscriber agrees that this section shall in no way infringe upon the rights of UNO Capital to pursue legal remedies or to collect damages and that this section shall be enforceable regardless of whether UNO Capital seeks any other such legal remedies and irrespective of the outcome.

10. Information Rights :

UNO Capital may retain and use for its purposes all information user provides, including but not limited to site demographics, contact, and billing information.

You agree that UNO Capital may transfer and disclose to third parties relevant personal information for approving and enabling participation in the Service, including to third parties that reside in jurisdictions with less restrictive data laws than UNO Capital.

UNO Capital disclaims all responsibility, and will not be liable to user, however, for any disclosure of that information by any such third party. UNO Capital may share aggregate information with advertisers, partners, sponsors, and third parties.

Also, the user grants UNO Capital the right to access, index and cache any portion thereof, including by automated means.

11. System & Network Security :

The user is prohibited from attempting to violate the security of UNO Capital’s network. Violations may result in civil or criminal liability. UNO Capital will investigate occurrences, and may involve, and cooperate with, law enforcement authorities.

12. Disclosure to Law Enforcement :

UNO Capital prohibits the use of our service for illegal activities. Therefore, the user agrees that UNO Capital may disclose any subscriber information including assigned IP numbers, account history, account use to any law enforcement agent who makes a written request without further consent or notification to the Subscriber. Also, UNO Capital shall have the right to terminate all service outlined in this agreement.

13. Electronic Delivery Policy :

UNO Capital, as a business, transacts with most users electronically. When you sign up, you consent to receive electronically from UNO Capital any agreements, disclosures, communications, or other records (collectively, ‘notices’).You agree that UNO Capital can send you electronic notices in either or both ways: (1) to the e-mail provided during registration or (2) UNO Capital may post notices. You agree certain services may have their own notice procedures and you must check e-mail regularly for such announcements.

The delivery of any notice from UNO Capital is effective when sent by UNO Capital, regardless of whether or when you receive it. Your only method of withdrawing consent to receive Notices electronically is to terminate any subscriptions, services provided.

All e-mail content delivered from/by/through UNO Capital is confidential and meant for the intended recipient. If you have received this e-mail in error and that any use, dissemination, of such e-mail, is prohibited. If received in error delete it. Although e-mails are scanned, UNO Capital cannot accept responsibility to scan attachments (if any) for viruses.

14. Denial of Service :

UNO Capital reserves the right to refuse or deny service to anyone, at any time, for any reason.

15. Trademarks :

All trademarks appearing on UNO Capital website are the property of their respective owners, including, without limitation, UNO Capital.

16. Changes to The Service :

UNO Capital has the right at any time to change, modify, add to or discontinue any feature of the Service including, but not limited to, the hours of availability, access or use, on your behalf. UNO Capital has no obligation to provide you with notice of any such changes.

You may not harvest information about UNO Capital users. Any violation may result in termination of your account.

A. The provisions of these Terms of Service addressing disclaimers of representations and warranties, limitation of liability, indemnity obligations, intellectual property, premium Services, and governing law shall survive the termination of these terms of service and your registration with the UNO Capital services.

B. These operating rules for any functionality of established by UNO Capital constitute the entire agreement between UNO Capital and you and supersede all previous written or oral agreements. In the event of any inconsistency between these terms of service and any such other terms of use of a specific UNO Capital service, these terms will supersede.The terms of Service shall be governed by and construed following the laws of the UAE regard to its conflict of laws rules.

You expressly agree that the exclusive jurisdiction for any claim or dispute under the terms of service and or your use of the UNO Capital service resides in the courts located in Dubai, UAE and you expressly agree to submit to the jurisdiction of such courts to litigate any claim or action.

The preceding provision may not apply to you depending on the laws of your jurisdiction. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not be given any legal import.

C. You must provide us with, and keep current contact information. E-mail, telephone contacts are used, in that order of preference.

D. A waiver by UNO Capital of any breach of any provision of this Agreement by the user shall not operate as or be construed as a continuing or subsequent waiver thereof or as a waiver of any violation of any other provision thereof.

E. User shall not transfer or assign this agreement without the prior written consent of UNO Capital. UNO Capital reserves the right to cancel users rights under this contract at any time without further obligation.

F. UNO Capital takes no responsibility for input by others and not posted to UNO Capital and not responsible for content of links provided. UNO Capital disclaims any responsibility for inappropriate use or liability to any person or party for violation of this policy.

G. UNO Capital is not responsible for any damages you or your business may suffer and does not make implied or written warranties for a specific purpose – this includes loss of data resulting from delays, non-deliveries, and service interruptions.
